- Any damage caused by decisions of Operating Committee -- POLA, POLB, UP and BNSF each responsible for 25% of any liability not covered by insurance
- ACTA to obtain business interruption insurance at least equal to two years of Use Fees and Container Charges
- Railroads may self-insure
- Corridor Dispatcher, Corridor Maintenance Contractor and other third parties required to carry general liability insurance -- $25 million per occurrence
- ACTA to obtain all-risk property insurance
